Critical Legal Notice: SECP Registration ≠ Trademark Protection
Many entrepreneurs mistakenly assume that registering a company with the Securities and Exchange Commission of Pakistan (SECP) automatically protects their brand name. It does not. SECP registration only confers corporate entity status. If a competitor files a Trademark with IPO-Pakistan for your brand name or logo, they can legally shut down your business, seize your social media handles, and obtain a court injunction against you under Section 40 of the Trade Marks Ordinance, 2001.
The 5 Statutory Stages of Trademark Registration in Pakistan
Governed under the Trade Marks Ordinance, 2001 and Trade Marks Rules, 2004 administered by IPO-Pakistan.
Pre-Filing Availability Search (Form TM-55)
Before applying, an official search across the Trade Marks Registry database in Karachi/Lahore/Islamabad is conducted to confirm no phonetically or visually similar marks exist in your target Nice Class.
Electronic Filing & Examination (Form TM-1)
Form TM-1 is submitted electronically along with the visual mark representation, goods specification, and Form TM-48 (Legal Power of Attorney). IPO issues an official Acknowledgement Receipt with a permanent Application Number.
Statutory Examination by Examiner
The Registrar of Trade Marks evaluates the application under Section 14 (Absolute Grounds) and Section 17 (Relative Grounds). If an objection is raised, our advocates submit statutory legal replies and attend hearings.
Trade Marks Journal Publication
Upon acceptance, the mark is advertised in the official monthly Trade Marks Journal. A statutory 4-month window is granted for public opposition under Section 28 of the Ordinance.
Issuance of Official Registration Certificate (Form TM-11)
If no opposition is filed, the Registrar issues the definitive sealed Certificate of Registration. The applicant acquires absolute legal monopoly, the statutory right to use the ® symbol, and 10-year nationwide protection renewable indefinitely.

Expert Answers on IPO Trademark Law
Can an individual or freelancer register a trademark without a company?
Yes. An individual, sole proprietor, partnership firm, or private limited company can apply for a trademark in Pakistan. You do not need an existing registered company to protect your brand name.
What is the difference between ™ (TM) and ® (R) symbols?
The ™ (TM) symbol can be used immediately upon filing Form TM-1 to signal to the public that an application is pending. The ® (Registered) symbol can only be legally used once IPO-Pakistan officially issues the final Certificate of Registration. Using ® before final certificate issuance is a punishable offence under Section 107 of the Trade Marks Ordinance.
Can I protect my Trademark internationally from Pakistan?
Yes! Pakistan is a contracting party to the Madrid Protocol administered by WIPO. Once your basic trademark application is filed in Pakistan, our advocates can extend your trademark protection to over 130 countries worldwide with a single international application.
What happens if someone infringes on my registered trademark?
Under Section 46 of the Trade Marks Ordinance, 2001, a registered trademark owner can initiate civil infringement proceedings in the High Court or District Court to obtain permanent injunctions, recovery of damages, and seizure/destruction of counterfeit products by the Federal Investigation Agency (FIA).
